Title 16 › Chapter 46— PUBLIC UTILITY REGULATORY POLICIES › Subchapter I— RETAIL REGULATORY POLICIES FOR ELECTRIC UTILITIES › § 2612
Apply the chapter to any electric utility for a calendar year if that utility sold more than 500,000,000 kilowatt-hours (kWh) to end users (not for resale) in any calendar year that started after December 31, 1975 and before the immediately preceding calendar year. The rules do not cover a utility’s operations or cases that only involve sales for resale. Before each year, the Secretary must publish a list of utilities covered that year, and each State regulator must quickly tell the Secretary which listed utilities the State has authority over for setting rates.
