The Secretary, any affected electric utility, or any electric customer of an affected utility has the right to join and take part in proceedings about electric rates or how rates are set. They can start or participate in talks about standards from subchapter II or other ideas that help the chapter’s goals. These proceedings may be run by a state regulator (for utilities it controls) or by a nonregulated electric utility. Anyone who joins can get relevant information that other parties can see. That information is obtained under reasonable discovery rules set by the state regulator or by the nonregulated utility. If a proceeding began before November 9, 1978 but was not finished by that date, joining is allowed only if it meets the normal timing rules of the law.
