Title 16 › CHAPTER 51 — ALASKA NATIONAL INTEREST LANDS CONSERVATION › SUBCHAPTER III — FEDERAL NORTH SLOPE LANDS STUDIES, OIL AND GAS LEASING PROGRAM AND MINERAL ASSESSMENTS › § 3148
The Secretary must set up an oil and gas leasing program for Federal lands in Alaska that are not part of the section 3141 study and are not in the National Petroleum Reserve—Alaska. The Secretary must not lease lands where the law forbids it or where a National Wildlife Refuge unit would be harmed after the Secretary weighs the national interest. The Secretary will study areas likely to have oil or gas and can let others do studies by permit. Permits can allow geological, geophysical, or other assessments if those activities fit how the land is managed. The Secretary must talk with the Secretary of Energy and ask the Governor, local governments, Native regional and village corporations, the Alaska Land Use Council, industry, conservation groups, and others for their views. The Secretary should encourage the State to do similar studies and try to coordinate Federal and State work. The Secretary may issue leases under the Mineral Leasing Act of 1920 and set the lease rules. Before any work, a lessee must give an exploration plan and get approval if the work will protect and fit the land’s managed use. If oil or gas is found in paying amounts, the lessee must give a development and production plan and get approval if it fits land protection and use requirements. The Secretary will watch operations and can require a revised plan if big changes happen, such as environmental or economic shifts. If continuing a lease would cause immediate, irreparable harm that won’t go away and cancellation is better than keeping the lease, the Secretary must suspend operations for up to five years. If the harm continues after five years, the Secretary must cancel the lease and provide compensation under rules the Secretary sets.
