The Secretary cannot spend program money to buy easements on certain lands. That includes lands owned by other federal agencies (except Indian trust lands), lands owned by a State or local government, land already under an easement or deed restriction that gives similar protection, or land where on-site or nearby problems (like hazardous substances, rights-of-way, development, or nearby uses) would make the program ineffective. The Secretary may give priority to land in the Conservation Reserve Program with a contract ending within 1 year: for agricultural easements, grassland that needs long-term protection; for wetland easements, high-value wetlands likely to go back into production after leaving CRP. The Secretary may allow changes to existing easements or other land interests, including lowering priority for utilities or energy lines, swapping, modifying, or ending interests, but only if the change increases or does not greatly hurt conservation, affects little acreage, and is in the public interest. Modifications or exchanges must avoid impacts when possible and keep or improve conservation and economic value, follow the easement’s original purpose, and cannot raise payments to the eligible entity. To end an interest the United States must be fully paid for fair market value, costs, and any damages, and the end must meet a compelling public need with no practical alternative. The Secretary must get the landowner’s and eligible entity’s consent for these actions and must give written notice to the House and Senate Agriculture Committees at least 90 days before a termination. Land enrolled in the wetlands reserve, grassland reserve, or farmland protection programs on the day before February 7, 2014, is treated as enrolled in this program. The Secretary may not give program help unless the recipient agrees, during the crop year of the help, to follow the program’s conservation and wetland protection rules.
