Title 16 › Chapter 1— NATIONAL PARKS, MILITARY PARKS, MONUMENTS, AND SEASHORES › Subchapter XLI— HAWAII NATIONAL PARK › § 393
Valid land claims made before August 1, 1916 stay in force. That includes homesteads, mining claims, rights-of-way, and other claims. Those owners keep full use and enjoyment of their land. The February 15, 1901 law about rights-of-way in some national parks and forests still applies to park lands when it fits the park’s main purposes. The Secretary of the Interior may allow easements or rights-of-way for steam, electric, or similar transportation across the park under conditions he sets. Private or city-owned land inside the park that was owned before August 1, 1916 is not changed by these rules.
