Title 16 › Chapter 1— NATIONAL PARKS, MILITARY PARKS, MONUMENTS, AND SEASHORES › Subchapter XLII–A— KALOKO-HONOKO̅HAU NATIONAL HISTORICAL PARK › § 396d
Creates the Kaloko-Honokōhau National Historical Park in Hawaii to protect and teach about traditional native Hawaiian culture and historic land use. The park covers approximately 1,300 acres as shown on a map dated May 1978, and its boundary was later changed to add Parcels 1 and 2 totaling 2.14 acres on a map dated April 2002; those maps are kept on file and open to the public. Except for lands owned by the State of Hawaii (which can only be acquired by donation), the Secretary of the Interior may acquire park lands by donation, exchange, or purchase using donated or appropriated funds. The Secretary must run the park under National Park Service law and the 1974 study report. The park may include traditional native Hawaiian accommodations. The Secretary can work with the State of Hawaii to manage submerged lands under state marine rules, and may allow commercial, recreational, and subsistence fishing, shoreline gathering, and boat access where those uses do not conflict with park purposes and are regulated by the Secretary. The Secretary may make agreements to protect air and water quality and scenic values, using the traditional Ahupuaʻa land-and-water management idea when feasible. The Secretary is authorized to hire native Hawaiians (defined as direct descendants of the people living in the islands before 1778). An advisory commission called Na Hoa Pili O Kaloko-Honokōhau of nine Hawaii residents (at least six native Hawaiians) will advise the Park Service; members are appointed by the Secretary for five-year terms with staggered initial terms, serve without pay, include certain nonvoting ex officio officials, must meet at least twice a year, and the commission ends on December 31, 2018. Up to $25,000,000 is authorized for land acquisition and $1,000,000 for development.
