§410nn–2 Acquisition of Property

Summary

The Secretary may get land or land rights inside the park by donation, by buying them with donated or appropriated funds, or by trading for them. The Secretary of Commerce may transfer the Liberty Ship SS Jeremiah O’Brien to the Secretary for the park’s historic fleet. Other federal property inside the park can be transferred at no cost if the agency in charge agrees. Land owned by the State of California or its local governments can only be accepted as a donation. The Secretary may work with the State or local governments and use appropriated funds to improve berthing facilities if the State provides land or land rights on terms the Secretary accepts. The Secretary may also acquire vessels, heavy marine equipment, and drydock facilities by donation, purchase, or exchange to help run the park. The Secretary must notify the House Committee on Natural Resources and the Senate Committee on Energy and Natural Resources in writing at least 90 days before acquiring any large historic vessel, and must include estimated costs to preserve, restore if needed, and maintain the vessel. The Secretary must not acquire any historic vessel under this rule until the Secretary has told those committees that enough funds have been made available to preserve and maintain the vessels listed in section 410nn–1(e)(1).
