Title 16 › CHAPTER 1 — NATIONAL PARKS, MILITARY PARKS, MONUMENTS, AND SEASHORES › SUBCHAPTER LIX–UU — MARTIN LUTHER KING, JR. NATIONAL HISTORICAL PARK › § 410www–1
The Secretary of the Interior must run the Martin Luther King, Jr. National Historical Park and Preservation District under the same rules that apply to national historic sites, including the Act of August 25, 1916 (39 Stat. 535; 16 U.S.C. 1, 2–4) and the Act of August 21, 1935 (49 Stat. 666; 16 U.S.C. 461–7). The Secretary may acquire land inside the park by donation, purchase (using donated or appropriated funds), transfer, or exchange, but land owned by the State of Georgia or its local governments can be taken only by donation or exchange. Land owned by Dr. King’s widow or by the Martin Luther King, Jr. Center for Social Change may be acquired only with the owner’s consent, except if the property is being or will be used in a way that conflicts with park purposes, and the Secretary has the first right to buy Center-owned property at a price not above its fair market value on the date offered. Acquired land may have conditions the Secretary finds consistent with park goals; for example, the widow may be interred at Dr. King’s burial site if it is acquired. Any title or interest held by HUD in the property labeled “Parcel A” on the map in section 460bbbb is transferred to the Secretary. National Park Service space needs should, as much as possible and without displacing residents, be met by reusing existing buildings inside the district.
