Title 16 › CHAPTER 1 — NATIONAL PARKS, MILITARY PARKS, MONUMENTS, AND SEASHORES › SUBCHAPTER LXXXVII — GATEWAY NATIONAL RECREATION AREA › § 460cc–2
The Secretary must run the recreation area under the rules of the 1916 law and can use available conservation powers to protect wildlife and natural resources. The islands and waters in the Jamaica Bay Unit must be managed first and foremost to conserve natural resources, fish, and wildlife, and no uses that conflict with that goal are allowed. The main visitor center must be named the William Fitts Ryan Visitor Center, and the Secretary must put up signs and materials and take additional commemorative steps by December 31, 1980. Miller Field on Staten Island is renamed World War Veterans Park at Miller Field in all official U.S. records. The Secretary can make reimbursable agreements with New York and New Jersey for rescue, firefighting, and law enforcement help. Army water projects (like erosion control, beach protection, and navigation work, including deepening the shipping channel) and Transportation airway work must follow plans agreed to by the Secretary and the relevant Cabinet Secretary and must fit the recreation area’s purposes; airport runways may not be extended into Jamaica Bay, nor may air facilities be added at Floyd Bennett Field. Hunting, fishing, shellfishing, trapping, and collecting are allowed under federal and state law, but the Secretary can set zones or seasons to protect people, wildlife, or park use. The Secretary must list and take care of historic sites and buildings in the Sandy Hook and Staten Island Units. Donations of money for services or facilities can be accepted. The United States gives the City of New York the rights to methane from the Fountain Avenue Landfill, but the city must pay 50% of any revenue to the United States and get permits that require site restoration and Secretary access. The Secretary may also grant easements or rights-of-way to state or local governments for flood and shoreline projects, charging only for processing and management costs; the same rule applies for similar easements in Golden Gate National Recreation Area.
