Title 16 › CHAPTER 1 — NATIONAL PARKS, MILITARY PARKS, MONUMENTS, AND SEASHORES › SUBCHAPTER CXLVI — PISTONE-BLACK MOUNTAIN NATIONAL CONSERVATION AREA › § 460iiii
Creates the Pistone-Black Mountain National Conservation Area in Mineral County, Nevada, to protect the Pistone Site on Black Mountain. The area covers about 3,415 acres of BLM land as shown on the map dated May 12, 2020, and any valid existing rights remain in place. The "Secretary" means the Secretary of the Interior and the "Tribe" means the Walker River Paiute Tribe. The Secretary must manage the area to protect its historic, cultural, archaeological, natural, and educational values, allow only uses that support those purposes, include it in the National Landscape Conservation System, and follow applicable federal laws. The Secretary must give the Tribe access to and protect the Tribe’s cultural resources and burial sites, and any cooperative agreement with others must include the Tribe. The Secretary must write a management plan not later than 2 years after December 23, 2022, after consulting state, tribal, local officials, and the public; the plan must describe uses, consider nearby plans and studies, and provide for a cooperative agreement with the Tribe. Public land in the area is withdrawn from public-land disposals, mining claims, and mineral or geothermal leasing, and any interests acquired after December 23, 2022 are withdrawn when acquired. State fish and wildlife authority stays in place, but the Secretary can set limited no-hunting/fishing/trapping areas or times with notice and consultation except in emergencies. Existing grazing allowed on December 23, 2022 may continue under law. No buffer zone is created, military overflights and related activities are not restricted, and no water rights are reserved.
