Allows the Secretary of Agriculture (through the Forest Service) to hire, fire, and pay workers to run the Recreation Area, with pay levels similar to other National Forest units. For at least 5 months after the area transfers, eligible Tennessee Valley Authority (TVA) employees stay on TVA payroll but work under the Secretary’s direction; the Secretary must pay TVA back for their pay and give any employee at least 60 days written notice before ending their employment, although employees can be fired for cause during that time. Eligible TVA employees can apply for Forest Service jobs under federal hiring rules. The Forest Service must follow Department of Agriculture hiring rules, tell eligible TVA employees about openings there before telling others, and may hire eligible employees without competition for area jobs. TVA must do the same for TVA openings. The Secretary, the Office of Personnel Management, TVA, and the TVA Retirement System must make a written agreement on how retirement and benefits move. Employees who move to other TVA units keep their benefits. Those hired by the Forest Service must get retirement and health benefits equal to what they would have kept at TVA, join CSRS Offset and may switch to FERS within six months, and may get credit for prior TVA service (with any required deposits treated tax-favorably). If TVA retiree funding is affected, TVA must cover shortfalls and reimburse the Secretary for transfer costs. If an eligible employee is let go as excess and does not take a Forest Service job, the agreement parties must provide a comparable package. At minimum the person can choose one severance option ($1,000 × years of service, but not less than $15,000 or more than $25,000; OR pay equal to the last 26 weeks; OR add 5 years to age and service), plus 15 months of health coverage for the employee and dependents, one week of pay per year of service, lump-sum pay for unused annual leave, unemployment under state law, TVA retirement benefits, and retraining help. If paying these benefits would hurt the TVA retirement system, TVA must fund any shortfall.
