§460o–2 Designation of Area; Boundaries

Summary

The Secretary of the Interior must declare the area established by publishing a notice in the Federal Register as soon as possible after September 1, 1965, and after the Army transfers control of the lands shown on the map in the law that can be managed as one unit. The notice must give a detailed boundary and, where practical, include the lands and waters shown on that map. Before the formal declaration, the Interior Secretary will manage the transferred lands and waters in line with the project’s construction and the planned creation of the area. The Interior Secretary may later change the boundary by publishing a new description in the Federal Register and may acquire more land, including by exchanging excluded for included lands and using money if needed to equalize values. Any new boundary may not include more acreage than the detailed boundary first described. For lands bought under the law for recreation, the Secretary of the Army, with the Interior Secretary’s agreement, may allow existing uses to continue if they fit the area’s purposes.
