§460uu–46 Exchanges and Acquisitions Generally; Withdrawal

Summary

Land trades under this subchapter must follow the law and are normally for equal value. Either side can pay or accept cash to make values equal. If both parties agree and the Secretary finds it is in the public interest, a trade may be for unequal value. "Public lands" means the same thing it does in the Federal Land Policy and Management Act of 1976. Except as section 460uu–45 allows, any land the United States acquires inside a monument or conservation area after December 31, 1987 will become part of that monument or area and be managed the same way. Except where this subchapter says otherwise, federally owned lands inside the boundaries cannot be removed from Federal ownership or put in trust for a tribe, and, subject to valid existing rights, Federal lands inside the monument or conservation area and lands acquired on or after December 31, 1987 are withdrawn from entry, appropriation, disposal under the public land laws, from mining location and patent, and from mineral and geothermal leasing laws. The acre amounts given are approximate; if numbers and the maps conflict, the maps control. The Secretary must accept donations of lands next to the Pecos National Monument boundaries as of December 31, 1987 if taking them helps the monument; accepted lands become part of the monument and are managed that way. Capulin Mountain National Monument is renamed Capulin Volcano National Monument, and any federal record naming the old monument will be read as naming the new one. Section 1 of the Act of September 5, 1962 is changed so the monument includes the lands shown on the map titled "Capulin Volcano National Monument Boundary Map," number 125–80,014, dated January 1987. Federal lands inside the new boundaries are transferred to the National Park Service at no cost to be managed as part of the monument.
