Summary

The Secretary may get land or land rights inside the recreation area by donation, by buying with donated or appropriated money, or by trading. If a piece of land is partly outside the recreation area, the Secretary may buy the outside part too to lower severance costs. Lands and waters inside the recreation area that other federal agencies now manage, and that are not listed under section 460ww–1 as essential to the Summersville project, must be transferred at no cost to the Secretary. Nothing here changes the requirements of section 1102 of Public Law 99–662 or limits any federal agency’s authority to carry out the Summersville project, including recreation. When releasing water from the project, other agencies must work with the Secretary to protect public health and safety and to support whitewater and other recreational use.
