The Secretary may buy certain lands in the inland sector only if the owner agrees. These include improved property, land used for business or industry if it was used that way on December 31, 1970 or is certified by the Secretary as compatible with the goals of this law, timberlands managed for sustained yield so long as they meet or exceed the timber-production rules used on similar national forests (covering harvesting, replanting, and cleanup), and land used on December 31, 1970 mainly for private, noncommercial recreation if later improvements are certified by the Secretary of Agriculture as compatible. The Secretary can still buy timberlands or parts of them without owner consent when he finds they are essential for recreation use or to provide access to or protect recreation developments, and must, as much as possible, avoid harming neighbors’ access or reasonable economic use of nearby sustained-yield forestry.
