§4725 Relationship to Other Laws

Title 16 › Chapter 67— AQUATIC NUISANCE PREVENTION AND CONTROL › Subchapter III— PREVENTION AND CONTROL OF AQUATIC NUISANCE SPECIES DISPERSAL › § 4725

Last updated Apr 5, 2026|Official source

Summary

Federal agencies must follow all federal, state, and local environmental laws when they carry out the parts of this law about aquatic nuisance species. States and local governments still have the power to make and enforce rules about aquatic nuisance species and over fish and wildlife. But routine discharges from a vessel, including ballast water, are governed by the federal law that covers vessel discharges. Obeying state control or removal rules does not excuse a person from also following this federal law.
