Title 16 › Chapter 69— WILD EXOTIC BIRD CONSERVATION › § 4907
The Secretary must regularly check trade in exotic bird species that are not listed in any Appendix to the Convention. After giving notice and a chance for public comment, the Secretary may impose a temporary ban or limit on imports of a species from one or more countries if the Secretary cannot make the findings listed in section 4905(c)(2), (3), and (4) and if the ban or limit is needed to protect the species or fits the law’s purpose. The Secretary may also ban or limit imports of all exotic birds from a country if that country has not put in place a management program that ensures both conservation and humane treatment during capture, transport, and care, and if the ban or limit is needed or fits the law’s purpose. The Secretary must end any ban or limit when the reasons for putting it in place no longer exist.
