When the Commission tells the Secretaries that a coastal State is not following the Plan, the Secretaries must decide together within 30 days if the State is out of compliance. If they find the State is not complying, they must declare a moratorium that stops fishing for Atlantic striped bass in that State’s coastal waters. They must review comments from the Commission and the State before deciding. During a moratorium, no one may fish in the moratorium area, land striped bass taken in violation of the moratorium, land legally caught striped bass into that State while the moratorium applies, or keep striped bass caught incidentally (they must be returned to the water, even if injured). Violators face civil penalties under section 308 of the Magnuson Act (16 U.S.C. 1858). Vessels, gear, and fish used in violations can be forfeited under section 310 (16 U.S.C. 1860), and seized fish can be disposed by a court or by regulation if perishable. The Secretaries, or Coast Guard officers they authorize, may enforce the moratorium with the same powers available under section 311(b) of the Magnuson Act (16 U.S.C. 1861(b)), and the Secretaries may use other federal or state resources to help. The Secretaries may also issue rules to carry out these actions.
