Volunteers are not treated as Federal employees for normal job rules. That means they are not covered by federal laws about hours, pay, leave, unemployment, or federal employee benefits, unless the law below says otherwise. For three specific laws, volunteers are treated like Federal employees. Those are the tort claim rules in Title 28, the workers’ compensation rules in subchapter I of chapter 81 of Title 5 (counting as “employees” under section 8101), and the rules for loss or damage to a volunteer’s personal property under section 3721 of Title 31. “Volunteer” also includes someone who (1) is recruited, trained, and supported by a cooperator under a mutual benefit or cooperative agreement with either Secretary, and (2) works under the cooperator’s supervision as directed by the Secretary, including directions about work area and supervision, safety rules, verification visits, allowed equipment and actions, required training, and other necessary terms.
