Summary

You cannot make, use, or copy Smokey Bear’s picture or name, or anything that looks like him, unless the Secretary has rules that say you can. If someone does it without those rules, the Secretary can complain and the Attorney General can go to court to get an order to make them stop. The same rule covers Woodsy Owl, the name "Woodsy Owl", and the slogan "Give a Hoot, Don't Pollute". No one may make, use, or copy them in a way that looks like Woodsy Owl unless the Secretary allows it, and the Attorney General can sue to stop it after the Secretary complains.

(a)Whoever, except as provided by rules and regulations issued by the Secretary, manufactures, uses, or reproduces the character “Smokey Bear”, or the name “Smokey Bear”, or a facsimile or simulation of such character or name in such a manner as suggests “Smokey Bear” may be enjoined from such manufacture, use, or reproduction at the suit of the Attorney General upon complaint by the Secretary.
