Summary

Congress can approve whatever money it decides is needed to carry out this chapter. Money that is set aside for growing or buying nursery stock by a federal agency, or money given to a federal agency to pass to cooperating States for that purpose, can be spent for up to three fiscal years. The Treasury must hold a fund called the Conservation Technical Assistance Fund, run by the Secretary of Agriculture. It gets fees collected under section 590c(4) of this title, plus late payments, interest, and other amounts allowed under section 3717 of title 31. Money from the Fund can only be used if Congress provides it in an appropriations law, must pay costs of carrying out this chapter, and stays available until spent.

(a)Authorization of appropriations

There is authorized to be appropriated for the purposes of this chapter such sums as Congress may from time to time determine to be necessary. Appropriations for carrying out this chapter allocated for the production or procurement of nursery stock by any Federal agency, or funds appropriated to any Federal agency for allocation to cooperating States for the production or procurement of nursery stock, shall remain available for expenditure for not more than three fiscal years.

(b)Conservation Technical Assistance Fund

(1)In general

There is established in the Treasury of the United States a fund to be known as the “Conservation Technical Assistance Fund” (referred to in this subsection as the “Fund”), to be administered by the Secretary of Agriculture.

(2)Deposits

An amount equal to the amounts collected as fees under section 590c(4) of this title and late payments, interest, and such other amounts as are authorized to be collected pursuant to section 3717 of title 31 shall be deposited in the Fund.

(3)Availability

Amounts in the Fund shall—

(A)only be available to the extent and in the amount provided in advance in appropriations Acts;

(B)be used for the costs of carrying out this chapter; and

(C)remain available until expended.
