Title 16 › CHAPTER 3C — WATER CONSERVATION › SUBCHAPTER II — CONSERVATION AND UTILIZATION PROJECTS › § 590z–2
No irrigation water can be delivered from a project until repayment contract(s) are signed. The Secretary should make the contract with a water users’ organization when possible, or otherwise with the individual landowners. The contracts must include terms the Secretary thinks are needed to protect the United States. "Reimbursable construction costs" are the project costs the Secretary assigns to irrigation that were paid from the specified appropriations and any amounts the President says are reimbursable. Administrative expenses in Washington, D.C. are not included and cannot be charged to water users. The contracts must require repayment of the irrigation share of costs. The Secretary will set a development period of no more than 10 years starting with the first calendar year water is delivered. During that time the Secretary will set annual advance charges (for example, per acre-foot) to cover at least the operation and maintenance costs; any extra collections can be applied to the reimbursable construction costs. The United States will operate and maintain the project during the development period and may continue afterward if needed; users must pay in advance each year and the United States may suspend service for nonpayment. Repayment (except for Indian lands under existing law) may be spread in up to 40 annual installments, with the first due in the year after the development period ends on the date the Secretary fixes. Late payments get a penalty of at least 0.5% per month. Users must keep proper accounts, protect project works and lands, and the Secretary will set the size of farm units; no owner may receive water for more than one farm unit (except the United States). Land sold after project approval and within three years of water availability must be sold at or below the Secretary’s appraised value or the water right can be canceled for fraud.
