Title 16 › Chapter 88— WESTERN AND CENTRAL PACIFIC FISHERIES CONVENTION › § 6904
The Secretary of Commerce can make rules needed to meet the United States’ international duties under the WCPFC Convention and this law. The Secretary must consult with the Secretary of State and, for enforcement rules, the head of the department that runs the Coast Guard. These rules can include recommendations and decisions from the Commission. If the Secretary has choices about measures that affect fisheries run by a Regional Fishery Management Council, the Secretary may, when practical and within the WCPFC schedule, use the rule steps in the Magnuson‑Stevens Act (16 U.S.C. 1801 et seq.). The rules can apply to all vessels and people under U.S. jurisdiction, including U.S.‑flag ships anywhere, starting on the date the Secretary sets.
