Title 16 › Chapter 6— GAME AND BIRD PRESERVES; PROTECTION › § 690e
Lets employees of the Department of the Interior who are approved by the Secretary arrest, without a warrant, anyone they catch breaking these wildlife laws or the rules made under them. Those employees must take the person right away to an officer or court for questioning or trial. They can also carry out any warrants or court orders. A federal judge or magistrate can issue such warrants if a sworn statement shows probable cause. Any birds, animals, parts, nests, eggs, or natural growths taken, harmed, killed, or removed in violation of these rules can be seized by those employees or by marshals. If a court finds they were taken illegally or the person is convicted, the items become U.S. property and will be handled or disposed of as the Secretary of the Interior directs under the law.
