Before the Secretary signs any contract for revenue-producing visitor services in the preserve or its Addition, the Secretary must first offer a right of first refusal to Miccosukee and Seminole members who were providing those services on Jan 1, 1972 (Jan 1, 1985 for the Addition). For new services each Tribe has 90 days to respond; if both submit acceptable proposals they get 90 more days to form a joint agreement. If neither proposal is acceptable, the Secretary will provide the services under subchapter IV of chapter 1. No agreement may be transferred without the Secretary’s consent.
