A state must get the Secretary's approval before it can issue electronic stamps, and the Secretary can limit how many new states join the program each year. The Secretary cannot approve an application unless the state gives all the required information. An approved application must cover seven things, including the stamp's format and what identifying information it shows; any fee for the stamp; how the state will track and send money to the Secretary; how the state will send customer data to the Secretary; how stamps will be delivered; rules for issuing duplicate stamps; and any other policies the Secretary reasonably asks for. At least 30 days before accepting applications, the Secretary must publish the deadlines, who is eligible to apply, and the approval criteria.
