Title 16 › Chapter 8— UPPER MISSISSIPPI RIVER NATIONAL WILDLIFE AND FISH REFUGE › § 724
The United States cannot buy land for this program until the legislature of every State that contains any of the land agrees. Except for a lease, the U.S. cannot pay for the land until the Attorney General says the title is acceptable and ownership is transferred to the United States. An existing right of way, easement, or other reservation does not stop the purchase if the Secretary of the Interior finds it won’t interfere with use under this law, or if the deed says that the reservation will be governed by the rules made under this law.
