Title 16 › Chapter 10B— FISH RESTORATION AND MANAGEMENT PROJECTS › § 777e
States that want federal help must send their fish-restoration ideas to the Secretary of the Interior in one of two ways. They can make a broad five-year fish and wildlife plan based on at least 15 years of needs and update it at least every three years, or they can send detailed single projects. If the Secretary approves a plan or a project as substantial, the Federal Government can pay up to 75% of the cost for approved parts after the state and the Secretary agree in an annual agreement. The Secretary will not pay anything until that agreement is approved. If federal money is used for things not approved, the State must replace those funds before getting more. Administrative overhead charged to these programs by state central services cannot be more than 3% of the State’s yearly federal share. The Secretary may also agree to pay up to 75% of the first costs to buy land or build facilities now and to pay up to 75% of later costs over time. Any federal promise to pay depends on funds being available.
