FERC may let an applicant’s paid contractor prepare the environmental impact statement required for a hydropower license, if FERC picks the contractor from a list of qualified firms. The contractor must sign a FERC disclosure saying it has no financial stake in the project, and FERC will set the work rules and checks to avoid conflicts. FERC stays responsible for meeting the National Environmental Policy Act. For environmental assessments, FERC may let the applicant or the applicant’s chosen contractor prepare the assessment. FERC will tell potential applicants ahead of time what studies or information will likely be needed and may allow the applicant’s assessment to be filed with the license application. The rules apply to license applications filed after October 24, 1992.
