Title 16 › CHAPTER 12A — TENNESSEE VALLEY AUTHORITY › § 831c–1
When the TVA builds or changes a dam, reservoir, or navigable channel and a bridge, trestle, or other highway or railroad structure over the Tennessee River or its navigable tributaries is threatened, damaged, or needs to be raised, widened, or changed for navigation or flood control, the TVA must pay the reasonable actual cost to protect, alter, rebuild, move, or replace it. This also covers approaches and protective parts of the structure. The owner must be credited for any direct special benefits they get from the work. The TVA may make a contract with the owner to pay or to do the work. If the owner and the TVA cannot agree or if a contract is broken, either can sue in the U.S. District Court where the property is. The court will divide the total cost between the TVA and the owner under this law. The TVA’s share can be paid from TVA funds, and needed appropriations are allowed. Before any major changes, the location and plans must be approved by the Secretary of Transportation under existing law.
