Title 16 › CHAPTER 12B — BONNEVILLE PROJECT › § 832c
The administrator must give public power agencies and electric cooperatives first choice when selling power from the Bonneville project. Contracts must be set up so that at least 50 percent of the power is available to those public bodies and cooperatives until January 1, 1942. Power set aside but not actually bought can be temporarily sold as long as it does not stop those public buyers from getting their share before January 1, 1942. After that date, public bodies and cooperatives still keep priority over any private buyer when applications conflict. If a public body or cooperative needs bonds or other financing to buy and distribute the power, its request cannot be denied just because the financing is not yet approved or sold. The administrator must give a reasonable time, decided by the administrator, for organizing, holding elections if needed, arranging financing, and building or buying distribution facilities so they can legally buy and sell the power.
