People must not import, make, or sell a digital audio recording device or medium unless they record the required notice and then send the statements of account and the royalty payments set out in section 1004. If a maker or importer puts out a product category or technology they have not previously reported, they must file a notice with the Register of Copyrights in the form the Register requires. Makers and importers must also file quarterly and annual statements with the Register. An officer must certify each statement. The Register will make rules for verifying and auditing the statements, protecting confidentiality, and sharing them confidentially with interested copyright parties. Each statement must include the royalty payments required in section 1004.
