Title 17 › Chapter 13— PROTECTION OF ORIGINAL DESIGNS › § 1303
A design can be protected under this chapter even if it uses material the chapter normally excludes, as long as the design is a substantial revision, adaptation, or rearrangement of that material. That protection is separate from any protection that already covers the material used and does not give rights in the excluded parts or expand existing protections.
