Title 17 › Chapter 13— PROTECTION OF ORIGINAL DESIGNS › § 1323
When a claimant wins an infringement case, the court must give money to make up for the harm. The court can raise that award up to $50,000 or $1 per copy, whichever is greater, or instead give the claimant the infringer’s profits from sales tied to the design; then the claimant proves sales and the infringer proves expenses. No recovery is allowed for infringements more than 3 years before the complaint. The court may award reasonable attorney fees and may order infringing items and any plates, molds, or other tools used to make them destroyed or otherwise disposed of.
