Title 17 › CHAPTER 15 — COPYRIGHT SMALL CLAIMS › § 1504
You can choose to bring a copyright dispute to the Copyright Claims Board instead of going to a regular court. Using the Board is voluntary and does not take away your right to sue in federal court or ask for a jury. You must start a Board case within 3 years after the claim starts. Filing a Board case pauses the time you have to sue in federal court for the same claim while the Board case is happening, subject to other rules. The Board can decide certain copyright claims only, like infringement claims, declarations that something is not infringement, some misrepresentation claims about takedown notices, related counterclaims and usual legal defenses. Some claims are excluded, such as ones already in court, final court decisions, claims involving federal or state governments, or claims against people outside the United States unless they began the Board case. The Board can award money or require someone to stop infringing if the person agrees and the agreement is in the case record. For infringement money, the Board can give actual damages and profits or statutory damages, but there are limits: up to $15,000 per work for timely registered works; up to $7,500 per work (and no more than $15,000 total in one Board case) for works not timely registered. The Board cannot decide willfulness when it sets statutory damages. A person bringing a claim must choose actual damages or statutory damages before the final decision. No one can get more than $30,000 total in money from a single Board case (not counting any separate award of attorneys’ fees and costs in special bad‑faith situations). Usually each side pays its own lawyer, except in bad‑faith cases. The Board can hold multiple people jointly responsible if their claims come from the same actions. The Register of Copyrights may limit how many Board cases one person can file each year.
