§511 Liability of States, Instrumentalities of States, and State Officials for Infringement of Copyright

Summary

States, state agencies, and state officials acting in their official jobs can be sued in federal court for copyright violations by anyone. This covers the copyright rights listed in sections 106 through 122, importing phonorecords in violation of section 602, and other violations under this title. They can be ordered the same remedies as private defendants, including seizure and disposal under section 503; actual damages and profits and statutory damages under section 504; costs and attorney’s fees under section 505; and the remedies in section 510.
