If a person tests positive for HIV and was told that, they must not knowingly donate or try to donate body fluids (for example, blood, semen, organs, or tissues) for use by another person, unless it is for medical research or testing or done following all Health and Human Services rules in section 377E of the Public Health Service Act. A person can be convicted even if no one catches HIV. A conviction carries a fine of at least $10,000, prison for 1 to 10 years, or both.
