Anyone who on purpose sells, buys, uses to make money, or ships Native American human remains without the legal right under the Native American Graves Protection and Repatriation Act faces a federal fine, up to 1 year and 1 day in jail, or both. A second or later offense can bring up to 10 years in prison plus fines. Anyone who on purpose sells, buys, uses to make money, or ships Native American cultural items that were taken in violation of that Act faces a federal fine, up to one year in jail, or both. A second or later offense can bring up to 10 years in prison plus fines.
