Damaging an energy facility on purpose, trying to do it, or planning it is a federal crime. If the damage actually exceeds $100,000, or any damage causes or tries to cause a major interruption of the facility’s functions, the person can be fined, get up to 20 years in prison, or both. If the damage actually exceeds $5,000, the person can be fined, get up to 5 years in prison, or both. If someone dies because of an offense under these rules, the person can be imprisoned for any number of years or for life. Energy facility: a place that makes, stores, moves, or distributes electricity, fuel, or other energy, or a site for energy research; includes places still under construction or not working, but excludes facilities regulated by the Nuclear Regulatory Commission and interstate gas pipelines as defined in 49 U.S.C. 60101.
