People who run a business making, selling, or transferring obscene books, pictures, films, tapes, or other recordings, and who knowingly have those items with the plan to distribute them after they were sent across state or national borders, can be jailed for up to 5 years, fined, or both. "Engaged in the business" means a person who makes, sells, transfers, or offers to sell or transfer obscene stuff and spends regular time and effort doing that to try to earn money. It does not have to be their only job or actually make a profit. Offering for sale at once two or more copies of any obscene publication, or two or more obscene articles, or a total of five or more such items, will be taken as proof that the person is in that business unless they can show otherwise.
