Title 18 › Part I— CRIMES › Chapter 102— RIOTS › § 2102

Last updated Apr 5, 2026|Official source

Summary

Labels a public disturbance a "riot" when three or more persons are gathered and either someone in the group uses violence that creates an immediate and obvious risk of, or actually causes, damage to property or injury to a person, or someone in the group makes threats of violence and the group can carry out those threats right away, where doing so would create an immediate risk of, or cause, damage or injury. Says that "to incite a riot" or to "organize, promote, encourage, participate in, or carry on a riot" includes urging others to riot, but it does not mean simply speaking or writing ideas or beliefs unless those words call for violence or say it is right to commit violent acts.
