A federal judge, an authorized magistrate judge, or a state trial judge can order the arrest of someone in their area when the U.S. has an extradition treaty with another country or under section 3181(b). A sworn complaint must allege the person committed one of those foreign crimes. If the person’s U.S. location is unknown or they are expected to enter soon, the complaint and warrant can be filed in the U.S. District Court for the District of Columbia. If the judge finds enough evidence, the judge must send a certificate and the testimony to the Secretary of State so the foreign government can ask for surrender, and must order the person held in jail until surrender.
