Title 18 › Part II— CRIMINAL PROCEDURE › Chapter 209— EXTRADITION › § 3192
When a foreign government hands someone to U.S. agents so they can be brought here and tried for the crimes named in the extradition warrant, the President may take whatever steps are needed to move and protect that person. The President can guard them from violence, keep them in custody until trial and final release or sentence, and for a reasonable time after, and may use part of the Army, Navy, or state militia if needed.
