The Secretary of Defense must make rules, after talking with the Secretary of State and the Attorney General, that apply across the Department of Defense for arresting, holding, handing over, and removing people under this chapter and to help with proceedings under section 3265. The rules must, as much as possible, require telling people who are not U.S. citizens and who work with or accompany the Armed Forces abroad that they may be subject to U.S. criminal law; not getting that notice does not stop U.S. courts from having jurisdiction or serve as a defense. Those rules or any changes to them cannot take effect until 90 days after the Secretary sends a report with the rules or changes to the House and Senate Judiciary Committees.
