Title 18 › PART II — CRIMINAL PROCEDURE › CHAPTER 217 — INDICTMENT AND INFORMATION › § 3365
Lets courts change the written charge against someone before the judge or jury decides. They can make edits that don't add a new or different crime and that won’t unfairly surprise the person charged. If the change would add a new crime or a different crime, the court must get the defendant’s consent or give the defendant time to prepare, or the prosecutor must start a new charge. After a verdict or finding, the court may only fix mistakes in the wording or descriptions. It cannot change the substance of the crime charged once the case is decided.
