§3440 Defenses and Objections Determined on Motion—(rule)

Title 18 › PART II — CRIMINAL PROCEDURE › CHAPTER 221 — ARRAIGNMENT, PLEAS AND TRIAL › § 3440

Summary

Raise any defenses or objections that can be decided before the trial starts. You must tell the court about those issues on time or you might lose the right to use them later. The judge can hold a hearing and decide the issues before trial, and that decision can change how the trial goes. If there is a good reason to wait, the court may allow a late claim. Any other limits set by law still apply.
