§3441 Jury; Number of Jurors; Waiver—(rule)

Summary

A defendant can give up a jury trial if the defendant and the government agree in writing and the judge approves. The defendant and the government can also agree in writing to have twelve jurors or fewer. If there is no jury, the judge will hear the case and decide the facts. The judge can either give one overall decision or answer specific factual questions.
