Summary

A judge can order a new trial if it is needed to make things fair. A defendant must ask for a new trial within 14 days after the jury verdict or the judge’s finding of guilty, unless the request is based on newly found evidence. If it is based on newly found evidence, the defendant has up to 3 years after the verdict or finding of guilty to ask. If the case had no jury, the judge may order a new trial on the judge’s own motion for any reason the judge could have used if the defendant had asked.
