Title 18 › Part II— CRIMINAL PROCEDURE › Chapter 228— DEATH SENTENCE › § 3597
A U.S. marshal carrying out a death sentence may use state or local prisons, officials, or staff to help and must pay those costs if the Attorney General approves the amount. Employees of a state corrections department, the Justice Department, the Federal Bureau of Prisons, the U.S. Marshals Service, or contractors who work for them cannot be forced, as part of their job or contract, to be present at or take part in any prosecution or execution if it conflicts with their moral or religious beliefs. Participation in executions — means getting the person or the equipment ready and supervising others who do those tasks.
