Title 18 › Part III— PRISONS AND PRISONERS › Chapter 303— BUREAU OF PRISONS › § 4049
The Director of the Bureau of Prisons must routinely give oleoresin capsicum (pepper) spray to staff who work in prisons that are not minimum or low security and who might respond to emergencies, and to any other staff the Director finds appropriate. Staff must finish a training course on the spray before getting it and once every year after that. If a trained staff member moves to a different prison, they do not have to retake training just because of the move. Training must happen during regular work hours and they must be paid their normal rate. Staff issued the spray may use it to reduce violent acts by prisoners or visitors against themselves, other prisoners, other visitors, or staff.
